Licensing

Whether you are entering the mortgage banking industry or expanding into new regions, Shirk Law can handle your licensing needs. We have licensing staff that manage client licensing projects, from nationwide licensing campaigns to regional initiatives.

We have developed a systematic management framework. First, the firm maintains current licensing applications for every jurisdiction. Second, we maintain a listing of all the requirements for each license. This allows quick response  to inform clients what is needed for approval, and to manage multi-state licensing projects. Following submission, license applications are tracked until approval and clients are kept informed of license status. Once approved, license renewals can be calendared to provide ongoing assistance.

We handle all types of licensing matters, including:
-- Lending, brokering, purchasing and servicing
-- First and subordinate lien residential mortgage loans
-- Closed-end and open-end transactions
-- Conforming and subprime loans
-- Federal and quasi-federal approvals, including HUD/FHA, VA, FannieMae, FreddieMac, GinnieMae, and USDA
-- Changes of control
-- Trade name registration and license updates
-- Branch and cross-branch licensing
-- Exemption reviews
-- Renewal and annual report management
-- Regulatory agency and secretary of state audits to determine whether licensee maintains proper licensing and whether licensee remains in good standing

As a component of our licensing efforts, we handle corporate and organizational matters for corporations, limited liability companies, and partnerships. These matters include:
-- Qualification to do business in foreign jurisdictions
-- Qualification renewals and annual reports
-- Trade name registration, with both state and local agencies, and renewals
